Privacy Policy

This policy explains what personal information Sam Is Marketing Ltd collects, why we collect it, how we use it, and the rights you have over it.

1. Who we are

Sam Is Marketing Ltd ("Sam Is Marketing", "we", "us", "our") is a company registered in the United Kingdom. We build AI Smart Websites and marketing systems for professional service firms. We also provide services to clients in Nigeria.

For the purposes of UK data protection law, Sam Is Marketing Ltd is the data controller for personal information collected through this website and through our own marketing activity. Where we handle personal information on behalf of a client, for example enquiries submitted through a website we operate for them, we normally act as a data processor and the client is the controller.

2. Which laws apply

As a UK company we handle personal information in line with the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018. Electronic marketing and the use of cookies are also governed by the Privacy and Electronic Communications Regulations (PECR).

Where we provide services to clients or handle information relating to individuals in Nigeria, we also apply the Nigeria Data Protection Act 2023 (NDPA) and guidance issued by the Nigeria Data Protection Commission. The NDPA gives data subjects rights that broadly mirror those below, including access, rectification, erasure, restriction, objection and portability, and it requires a lawful basis such as consent, contract, legal obligation, vital interests, public interest or legitimate interests.

Where the two frameworks differ, we aim to apply whichever standard gives the individual greater protection. We do not claim any registration, certification or filing status under either framework that we have not actually completed.

3. Information we collect through this website

When you complete the consultation form on this website, we collect the information you provide and a small amount of technical information about how you arrived. Specifically:

We do not store your raw IP address. We store a one-way hashed value derived from it, which is used only to limit repeated automated submissions. We do not ask for special category information, and you should not submit confidential client details of your own through this form.

6. AI and automation

Sam Is Marketing provides AI-assisted website, marketing and automation services. Depending on what a client has configured, this can involve processing enquiry information through third-party technology providers in order to deliver website functionality, AI-assisted messaging, voice handling, email, SMS, appointment scheduling, automated follow-up, analytics, advertising and marketing systems.

We will not tell you that AI systems never retain data, because retention depends on each provider's own terms and on how a given system is configured. What we can tell you is that we only enable the components a client has actually purchased, and we ask our providers to handle information under contractual terms consistent with applicable data protection law.

AI-assisted communication is used to help handle routine enquiries and follow-up. It does not replace professional judgement, and we do not use it to make decisions that have legal or similarly significant effects on you without human involvement.

7. Who we share information with

We share personal information only where it is necessary to run the business, and only with categories of recipient such as:

8. International transfers

We operate from the United Kingdom and also serve clients in Nigeria, and some of our technology providers are based outside the UK, including in the United States. This means your information may be transferred to, stored in or accessed from a country outside the UK.

Where we make such a transfer, we rely on an appropriate safeguard recognised under UK data protection law, such as UK adequacy regulations, the UK International Data Transfer Agreement, or the UK Addendum to the EU Standard Contractual Clauses, together with any additional measures needed in the circumstances.

9. Cookies and similar technologies

This website uses only what is strictly necessary to work. It stores your progress through the consultation form in your browser's session storage so that an accidental refresh does not lose your answers. That value stays on your device, is cleared when you finish or close the tab, and is not used for advertising.

We do not currently run analytics, advertising or social media tracking on this website. There is deliberately no claim here about Google Analytics, Meta Pixel or any similar tool, because none of them is installed.

If we later add analytics or advertising technologies, we will update this section and, where PECR requires it, ask for your consent through a cookie banner before those technologies are set.

10. Analytics and measurement

We measure marketing performance using the attribution values described in section 3, which tell us which campaign or channel an enquiry came from. That is done from our own records rather than through third-party tracking on your device.

No third-party analytics or advertising platform is installed on this website at the effective date of this policy. We are not going to list tools we do not run.

Where we manage advertising or analytics for a client on their own website, that processing happens under the client's instructions and is covered by the client's own privacy notice.

11. Email, SMS and voice communications

If you give us your email address and phone number through the consultation form, we may use them to reply to your enquiry, confirm your consultation and follow up about it. Those messages may be sent or assisted by the automated systems described in section 6.

Messages are delivered through third-party email, messaging and telephony providers, which process the message content and delivery data needed to send them. Where SMS is used, you can stop further messages by replying STOP.

We do not record telephone calls with enquirers unless we tell you at the start of the call and the applicable notice or consent requirements have been met. If a call is recorded, the recording is used only for the purpose stated at the time, such as accuracy of notes, quality or resolving a dispute.

12. Marketing communications

If you submit the consultation form, we will contact you about your enquiry and the consultation you have asked for. That is the purpose you gave us the information for.

If we later send you wider marketing about our services, every message will include a clear way to opt out, and you can also ask us to stop at any time by contacting info@samismarketing.com. Opting out of marketing does not stop necessary messages about a service you are actually receiving from us.

13. How long we keep information

We retain personal information only for as long as reasonably necessary to fulfil the purposes for which it was collected, including providing our marketing services, managing enquiries, maintaining client relationships, resolving disputes, and complying with our legal, accounting and regulatory obligations.

Our retention periods may vary depending on the type of information and the reason it was collected. As a general approach:

Enquiry and contact information: we may retain this for up to 24 months after our last meaningful interaction, unless a longer period is reasonably necessary.
Client and project information: we retain this for the duration of the client relationship and for a reasonable period afterwards for legitimate business, contractual, legal or dispute-resolution purposes.
Invoices, payment and accounting records: we retain these for the period required by applicable tax, accounting and legal requirements.
Marketing and communication preferences: we retain these for as long as necessary to manage your preferences and demonstrate compliance with applicable marketing and data-protection requirements.
Website and technical information: certain information, such as server logs and security records, may be retained for shorter or longer periods depending on security and operational requirements.

When personal information is no longer required, we will take reasonable steps to securely delete, destroy or anonymise it.

Where we need to retain information beyond the normal retention period to comply with a legal obligation, prevent fraud, resolve a dispute, or establish, exercise or defend legal claims, we may retain it for the period reasonably necessary for that purpose.

If you are not satisfied with how we have handled your information, you can complain to the Information Commissioner's Office at ico.org.uk. If you are in Nigeria, you may raise the matter with the Nigeria Data Protection Commission. We would prefer the chance to put things right first.

15. Security

Information submitted through this website travels over an encrypted HTTPS connection and is stored in a database that is not publicly accessible. Access credentials are held on the server and are never exposed to your browser. Enquiries are submitted through our own server rather than sent directly to a third-party platform from your device.

No system is completely secure, so we will not claim ours is. If a breach affects your rights and freedoms, we will notify the relevant regulator and, where required, you.

16. Children

Our services are provided to businesses. This website is not directed at children, and we do not knowingly collect information from anyone under 18. If you believe a child has submitted information to us, contact info@samismarketing.com and we will delete it.

17. Changes to this policy

We may update this policy as our services or the law change. The date at the top of the page shows when it was last revised. If a change materially affects how we use information you have already given us, we will take reasonable steps to tell you.
